Privacy notice.

How we handle personal data, under the Swiss Federal Act on Data Protection (revDSG) and the EU General Data Protection Regulation (GDPR Art. 13).

1. Data controller

2. EU representative under GDPR Art. 27

Madlener Informatik GmbH is established in Switzerland. Processing operations concerning persons in the EU take place only occasionally (occasional inquiries via the contact form). For that reason no EU representative under GDPR Art. 27 has been appointed. Should the business activity shift towards regular processing of EU data subjects, we will reassess this question and appoint a representative if required.

3. Encryption

This website is served exclusively over a TLS-encrypted connection (HTTPS). Form content submitted in transit is therefore protected from interception by third parties.

4. Cookies and tracking

This website uses no cookies, no local-storage tracking, and no third-party scripts. No fingerprinting techniques are used. Web fonts are served directly from our server, not loaded from an external CDN. There is no reach measurement and no web analytics. For that reason no consent to a cookie banner is required either. There simply is nothing to which consent would have to be given.

5. Processing when the website is accessed (server logs)

When the website is accessed, technical access data is automatically logged by our hosting provider (see section 7) in server log files:

  • IP address of the requesting device
  • Date and time of the access
  • URL requested
  • Bytes transferred and HTTP status code
  • Browser type and operating system (user agent)
  • Referrer URL (previously visited page, if transmitted)

Purpose: provision of the website, protection against attacks and abuse, error diagnosis.
Legal basis: GDPR Art. 6(1)(f) (legitimate interest in a secure and stable website operation) and revDSG Art. 31.
Retention: according to the standard retention period of our hosting provider (Ionos), typically a few days.

6. Processing when the contact form is submitted

When you use the contact form, you transmit the following personal data to us:

  • Name
  • Email address
  • Topic of your inquiry (selected from a list)
  • Free-text body of your message
  • Confirmation of this privacy notice (privacy checkbox)

Purpose: handling your inquiry and replying personally to the email address you provide.
Legal basis: GDPR Art. 6(1)(b) (initiation or performance of a contract for business-related inquiries) and GDPR Art. 6(1)(f) (legitimate interest in responding to inquiries).
Retention: inquiries are generally kept in the inbox for a maximum of 30 days unless an active engagement results from the conversation. If the inquiry leads to an engagement, commercial and tax retention duties apply (in Switzerland typically ten years).
Transmission: your message is delivered as email to our business mailbox (info@madlener-informatik.com). Both mailboxes (sending and receiving) sit with the same provider (Ionos), and the mail flow normally does not leave the provider's German infrastructure.

To protect the form against automated abuse (spam) we use two measures:

  • A field invisible to sighted users (honeypot pattern) that is filled out only by bots and lets us recognise their requests; no personal data is collected for this purpose.
  • A short-lived limit on the number of requests per IP address (rate limit). For this purpose a hash (SHA-1) of your IP address is stored on our server together with a timestamp for at most one hour. Legal basis: GDPR Art. 6(1)(f) (legitimate interest in preventing abuse).

7. Processors and data sharing

We do not share your data with third parties without a legal basis. For the technical operation of this website and for sending email we use the following processor:

IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany. Hosting of the website as well as sending and receiving email from the contact form via smtp.ionos.de. A data processing agreement under GDPR Art. 28 / revDSG Art. 9 is in place with IONOS.

No further transmission of your data to third countries takes place. In particular we do not use US service providers for web analytics, mailing, captcha or similar functions.

8. Your rights

You have the right at any time to:

  • Request access to the personal data we hold about you (GDPR Art. 15 / revDSG Art. 25).
  • Request rectification of inaccurate data (GDPR Art. 16).
  • Request erasure of your data, provided no statutory retention obligations conflict (GDPR Art. 17 / revDSG Art. 32).
  • Request restriction of processing (GDPR Art. 18).
  • Receive your data in a structured, commonly used, machine-readable format (GDPR Art. 20).
  • Object to processing of your data where it is based on a legitimate interest (GDPR Art. 21).

9. Right to complain

If you consider that our processing of your data violates applicable data protection law, you may contact the competent supervisory authority:

  • Switzerland: Federal Data Protection and Information Commissioner (FDPIC / EDÖB), Feldeggweg 1, 3003 Bern, www.edoeb.admin.ch
  • Germany (for EU visitors): The state data protection authority responsible for your place of residence. An overview is published by the Federal Commissioner for Data Protection and Freedom of Information (BfDI): www.bfdi.bund.de

10. Changes to this privacy notice

We reserve the right to adjust this privacy notice when the legal situation, our processing activities or technical circumstances change. The current version applies upon publication on this page. Substantial changes are marked by the date noted below.
